The Cohen hearing, attorney client privilege and Sean Hannity

17 April 2018

Cohen's lawyers were required by a federal judge in NY to disclose the names of his clients Monday as part of an argument over attorney-client privilege and how it applies to records seized from Cohen last week by the FBI.

It's a headache for Fox News, where Hannity is the highest-rated host and chief defender of Trump. When explaining that two different Playboy playmates were involved in the legal showdown, Colbert said, "I'm just glad Hef isn't alive to see his life's work dragged through the filth like this", in reference to Playboy's late founder, Hugh Hefner.

I don't think Hannity should be fired, or even suspended, although the ball is certainly in Fox News' court. Stephen Ryan, a lawyer for Cohen, drew gasps and laughter from the public gallery when he named Hannity as the client.

Mr Trump's attorney says the computers, phones and documents should be protected under attorney-client privilege.

Cohen revealed that he had advised the television host within the last 12 months as he sought to fight against a raid of his office and a hotel room by federal prosecutors in Manhattan.

On his afternoon radio show, Mr. Hannity questioned how his link to Mr. Cohen had become "such a big deal", adding that he never paid Mr. Cohen or used him as a lawyer "in the traditional sense".

A judge ruled that Michael Cohen, the president's personal attorney, must reveal the link to Sean Hannity.

Late-night comedian Jimmy Kimmel was next to pile on Hannity, wondering what kind of legal advice Hannity would need that didn't involve a third party "unless, maybe Sean Hannity was thinking about suing himself?"

The April 9 raid on Cohen sought information on a variety of matters, including a $130,000 payment made to Daniels, who alleges she had sex with a married Trump in 2006.

"The client's name is Sean Hannity", Ryan said. The other two are, of course, Donald Trump and Elliott Broidy, the just-resigned vice-chair of the RNC's fundraising committee.

"Yeah, it turns out Michael Cohen's secret client was Sean Hannity, which I'm sorry, is not a good look", Noah said with a chuckle. Brzezinski said about Hannity's failure to disclose his ties to Cohen while also defending the lawyer on TV. Instead, Hannity said he "occasionally had brief discussions about legal questions" with the attorney. And we'll endeavor right here to head off a likely argument before it pops up: No - conflict-of-interest requirements for opinion-side hosts shouldn't be any less stringent than they are for straight-news personnel.

Carrey couldn't help but taunt Sean Hannity after the TV host was named as one of Michael Cohen's secret clients during a hearing in NY yesterday.

"It seems that there's no limit at all into the fishing expedition that Mueller is now engaged in", Hannity said. Cohen's lawyers resisted revealing Hannity's name, saying it would be embarrassing and unnecessary. They exchanged insults on Twitter, with Hannity calling Kimmel a racist, pervert and "Harvey Weinstein jr." and Kimmel making a gay sexual innuendo in reference to Hannity's apparent love for Trump.

"Michael Cohen never represented me in any legal matter", he said.

The hearing in a New York City courtroom stems from a surprise Federal Bureau of Investigation raid on Cohen's home and office.

Carlson commented on the controversy ahead of Hannity's show, discussing Cohen's appearance in court on Monday.

Then, last night, he dedicated nearly a full three minutes at the end of his show to explaining how silly the "hysterical media" was being about this whole thing.
