Jammu and Kashmir shutdown over Article 370

13 August 2017

The seat has been lying vacant since July 4, 2016 after PDP chief Mehbooba Mufti resigned as a Lok Sabha member as she took over as the chief minister of Jammu and Kashmir. What matters is what the PM said.

Article 370 also accords the disputed region special status.

Ironically, while the PDP is a strong votary of continuing with the special status, its ruling partner the BJP contested elections on the plank that it would revoke the constitutional position for Jammu and Kashmir's complete integration with the rest of India.

Why do you want to remove Article 370?

After the Constitution of India came into force in 1950, Part II of the Constitution dealing with citizenship was not made applicable to Jammu and Kashmir and parliament had no power to make laws for the state on citizenship.

Article 35A was inserted in the constitution through a presidential decree in 1954. But before that, the Centre and state government should clear their stand on the issue, he added. She further said all mainstream political parties will lose relevance in the Kashmir Valley if Article 35 (A) is done away with. This is the first time that Kashmir has observed a shutdown to protect a provision of the Constitution of India.

"Her claim that people of J&K have rejected two nation theories in 1947 is distortion of facts, misleading and denying the Himalayan truth as people of the state had never ever acceded to India and neither has been their opinion sought through right to self-determination till date".

Mehbooba Mufti warned that any tinkering with Article 35 (A) would worsen the situation in the state when it was normalizing.

The Chief Minister said any attempt to change or abrogate Article 35 (A) was akin to questioning "the idea of India that has to accommodate with the idea of Jammu and Kashmir".

Professor Hari Om, a historian and social activist, said, "It is an atrocious article that creates a high wall between people of J&K and the rest of India". Speaker Kavinder Gupta who calls himself a proud RSS man was quick to constitute a panel on the violation of special status provisions and senior officers of the Geology and Mining Department were suspended.
