SC shoots Cong plea to nix NOTA for RS elections

A day prior to the Rajya Sabha elections, the Bharatiya Janata Party (BJP) said it is confident that it will acquire all three seats in Gujarat. Our MLAs are very committed as they did not leave even their homes on the occasion of Rakshabandhan, although we were keen to make every possible arrangement.

The Gujarat MLAs, whose stay in Eagleton Resort was taken care of by Karnataka's Energy Minister D K Shivakumar and his brother D K Suresh, who is Congress MP from Kanakapura, called on State Vajubhai Vala and visited the State secretariat on Saturday.

Vaghela, who resigned from the party and as the leader of the opposition, has not quit the House yet, giving the Congress a major cause for worry.The Congress had faced a major embarrassment in the presidential election when joint opposition candidate Meira Kumar could manage 49 votes when the party's strength then was 57. Meanwhile, the Nationalist Congress Party (NCP) on Monday said that it will support Congress in the Rajya Sabha polls in Gujarat.

"If we were here to enjoy, we would have accepted the Rs15 crore offer from the BJP", he added. "They will stay together and they will go to vote for the Rajya Sabha polls tomorrow (to Gandhinagar) from Anand", Congress chief whip Sailesh Parmar said.

He, however, said there was "public anger" towards the Congress MLAs, who were absent from their constituencies during the flood as they were shifted to Bengaluru. The Congress abandoned its voters during the heavy rains and floods. The BJP, rubbishing the Congress' charge that it is "poaching" MLAs, has said Sonia Gandhi and her son and deputy Rahul Gandhi are unable to keep their party together. Six Congress MLAs have already defected in the run up to the Rajya Sabha elections in the state, for which the party has blamed the BJP's use "threats and money power".

The party said that use of NOTA option during the Rajya Sabha elections was contrary to the mandate of the Constitution, the Representation of People's Act, the conduct of election rules as also judgements of the Supreme Court.

According to the state party unit, Shah, who arrived here late last night, would stay here till the completion of the Rajya Sabha polls, in which, he is one of the four contestants from the state.

"Why should you stand in the queue to press the NOTA button", he wondered.

In a major setback to Congress party, the Supreme Court today refused to stay the Election Commission's notification allowing None of the Above (NOTA) provision in the upcoming Rajya Sabha polls in Gujarat.
