Rosenstein must recuse himself from involvement in Mueller probe

19 June 2017

On "Face The Nation" on CBS, Sekulow clarified that he's so confident that there isn't any investigation into the president because they have not received any notification from the special counsel's office.

Speaking on NBC's "Meet the Press" Sunday, attorney Jay Sekulow said the "president is not under investigation by the special counsel".

However, Mueller's investigation is in a relatively early phase, and it is unclear whether criminal charges will be brought when it is complete, United States officials familiar with the matter told The Washington Post on Thursday.

President Trump now finds himself exactly where he doesn't want to be: under investigation by a dogged, highly respected prosecutor who owes him no personal or political loyalty.

On the following day in an Oval Office meeting with Russian officials, the President described his FBI chief as a "nut job" and "crazy" and expressed relief that the "pressure " of the Russia investigation had been lifted by the firing of Comey.

President Donald Trump's personal lawyer said on Sunday that Trump is not under investigation in the probe into alleged Russian meddling in the 2016 USA presidential race, a statement that appeared to contradict a comment Trump himself made on Twitter last week. Trump fired FBI Director James Comey, sent out spokespeople and surrogates with a far-fetched cover story to explain the dismissal, and then told NBC's Lester Holt that the real reason for the firing was Comey's pursuit of the Russian Federation investigation. Sekulow added that Trump is "very effective" with his use of social media. "No confusion. The president is not under investigation", Sekulow said.

"Let me clear. The presidents not under investigation, as James Comey said in his testimony, that the president was not the target of investigation on three different occasions", Sekulow told CNN in another interview.

"So, he's being investigated for taking the action that the attorney general and deputy attorney general recommended him to take, by the agency who recommended the termination".

The attorney on "Meet The Press" Sunday also acknowledged that the president was aware that firing James Comey as FBI director could extend the entire time frame of the investigation into Russian Federation.

"You just said two times that he's being investigated", Wallace said. For one thing, it wouldn't be a high crime or misdemeanor for the president to fire Mueller, Washington D.C. icon though he may be. Trump himself took aim Friday at the senior Justice Department official responsible for appointing Mueller, accusing him on Twitter of leading a "Witch Hunt". "Because the special counsel, under the special counsel regulations, reports still to the Department of Justice, not an independent counsel", Sekulow said.

Fox News reported that the president was talking about Rosenstein in the tweet. He went so far as to file a ridiculous ethics complaint against then-FBI Director James Comey over Comey's handling of the Clinton email investigation.

Adam Schiff, the top Democrat on the House intelligence committee, defended Mueller and his team, noting that lawmakers from both sides of the aisle have praised his appointment.
